Over Objections of Corrupt Judges, Politicians, ICE Arrests Illegal Aliens at Courthouse

In 2019 the Governor signed a bill that made it illegal for ICE to arrest criminals at a courthouse.  No not American criminals—they could be arrested==the Democrats and Governor wanted criminals from foreign countries to be safe from arrest by ICE.

Maybe the next time President Trump is in California Newsom will have him arrested for violating State law?  Or Newsom could arrest all the ICE officers involved?  Or Newsom can stop being a corrupt politicians protecting law breakers.  Better yet, Trump could have Newsom arrested for obstruction of justice and conspiracy to commit crimes?  We can dream, can’t we?

Undocumented immigrants arrested in California courthouse despite state law

The 2019 bill prevents civil arrests on courthouse grounds while a person has a hearing pending.

U.S. Immigration and Customs Enforcement (ICE) agents reportedly violated a California state law that prohibits immigration officers from arresting undocumented immigrants without a judicial warrant on Tuesday, according to the Associated Press

Two people were arrested in the Sonoma County Superior Court in Northern California, one of whom was supposedly awaiting a hearing. This goes directly against Assembly Bill No.668, the law that Democratic Governor Gavin Newsom signed in October 2019. 

The bill reiterates California’s power to regulate what occurs on state courthouse grounds, and fundamentally declares that “A person shall not be subject to civil arrest in a courthouse while attending a court proceeding or having legal business in the courthouse.”

Only the presence of a valid judicial warrant would allow officers — either ICE or other law enforcement — to arrest someone awaiting hearings in California. 

ICE justified the arrests by saying that California’s law does not supersede federal law, which still grants immigration enforcement officers authority to arrest “removable aliens inside the United States.”

“Our officers will not have their hands tied by sanctuary rules when enforcing immigration laws to remove criminal aliens from our communities,” David Jennings, ICE’s field office director in San Francisco, said in a statement quoted in AP.

The Sonoma County District Attorney Jill Ravitch and San Francisco District Attorney Chesa Boudin protested the arrests. Ravitch was quoted in Patch as saying, “ICE detention actions have no place in the court building, where they have the effect of scaring away witnesses and victims, and undermines the District Attorney’s Office ability to hold the guilty accountable and protect crime victims.” 

Sonoma County general counsel Bruce Goldstein further called the arrests “lawless,” since no necessary judicial records were included. 

Both arrested men are from Mexico, according to Justin Moor, a public affairs specialist at the U.S. Department of Homeland Security. Moor explained that the men had been arrested before. Antonio Hernandez Lopez has pending charges against him, including domestic abuse, a DUI and witness tampering. Lopez also has prior convictions for a 2005 DUI and a 2009 local ordinance conviction, according to Moor. 

The other man arrested was Pedro Romero Aguirre, who, according to Moor, also has “five criminal convictions spanning more than a decade, such as trespassing, driving without a license, and a DUI.”

  2. I think this is great. ICE should ignore the political legislation of states trying to restrict them from performing their duty. The wall gradually and incrementally makes it harder for deportees to return.
    Kate’s Law become a Federal Law sooner than later as some states continue to protect previously deported criminals.

  4. I’m so happy that the walls protecting illegal aliens is breaking down. These people broke our laws yet have more rights and better treatment from local government than citizens. That cannot be justified.

  5. They need to arrest that POS Pretty Boy Newsom ASAP to show the rest of the country that we mean business!! Oh, I forgot Becerra, Garcetti, and the Chiefs of Police for LA and San Fran!

  11. About time! This state is part of the USA and must follow Federal Laws that cover immigration! Those of us who are CA tax paying residents whose roots are here longer than Fancy Boy Newsome (who is so corrupt regarding laws, lies to be elected and does not listen to what his voters have passed but just follows his own liberal ideology), AG Becerra or the past legislator that wrote the sanctuary law protecting illegals while he did admit his own relatives were “illegal”. And, still waiting to find out what’s happening on Newsome’s recall….

      You probably already have the latest information, but will post this anyway for others. The deadline for Erin Cruz RANAF.org effort was Feb. 13, so we are still waiting to hear on that one. That effort accused many counties of refusing to turn over their signatures to the SOS. Not sure if this is true, or a stumbling block, or a rumor.
      The Dr. James Veltmeyer effort was unable to fund enough paid signature gatherers and he gave up his effort some time in January.

    I tire of even “conservatives” using the term “undocumented immigrants” when referring to (foreign invaders) and (criminal aliens). Governors,mayors and police chiefs from sanctuary cities and states are breaking federal immigration laws and should be arrested and charged in federal court.
