Court Finds IRS Actions Unconstitutional, Awards TTV Increased Fees Based on “Bad Faith Enhancement”

HOUSTON, TX, June 7, 2019 – The True the Vote v. IRS lawsuit has finally come to a close with a stunning ruling by U.S. District Court Judge Reggie Walton ruling in favor of True the Vote; penalizing the IRS with maximum attorneys fees due to their unconstitutional discrimination against the group and their unethical behavior in the case.

This decision marks the end of a nearly decade long battle that first began in 2010, when federal government agencies including the IRS, DOJ, FBI, ATF, OSHA weaponized against True the Vote and its founder, Catherine Engelbrecht. Under Obama Administration leadership, the agencies leveled a barrage of attacks, including twenty-three audits, investigations, and inquiries, against the group in an attempt to stop their work in election integrity.

In 2013, True the Vote brought suit against the IRS, seeking to prove that IRS actions were unconstitutional. The ensuing fight cost millions and nearly destroyed the only conservative voters rights organization in America.

True the Vote’s founder Catherine Engelbrecht said, “At the outset of this case, I testified before Congress and swore that I would never retreat or surrender. Today I have fulfilled that oath. Thank you to all the citizens across the country who stood steadfastly beside us. We could not have done it without your support.”

United States District Judge Reggie B. Walton signed a Consent Order that included the IRS admission of wrongdoing and affirmed that prejudice on the basis of an applicant’s name, association, or political viewpoint is an unconstitutional violation of First Amendment rights. Then, in a stunning rebuke of the IRS actions that led to this litigation, Judge Walton also ruled that True the Vote is entitled to a “bad faith enhancement” to its requested attorney’s fees. Judge Walton’s opinion held there is “clear and convincing evidence necessary for a finding of bad faith on the part of [the IRS]” in their discrimination against True the Vote. While the exact amount to be awarded is still pending, True the Vote’s application under the Equal Access to Justice Act requested the recovery of $1.9 million in attorneys’ fees.

“This ruling is a victory for all Americans,” says Engelbrecht. “Government cannot be allowed to run roughshod over the Constitutional rights of American citizens.”

District Court rejected the DOJ’s argument that True the Vote did not win this litigation battle.” Bopp also applauds “Judge Walton’s opinion which held not only that the IRS’s actions were not substantially justified, but were also rooted in ‘bad faith.’ The Court’s judgment that True the Vote won this litigation coupled with its opinion that the IRS acted in bad faith should be a warning to bureaucrats that the U.S. Constitution protects everyone, regardless of ideology.”

Brock Akers, of The Akers Firm, Counsel for True the Vote, says “The conduct of the IRS and the government was nothing short of shocking. This ruling ought to reflect a collective sigh of relief from everyone that the judicial system really can be turned to for a just end to this nightmare. Check one in favor of Justice v. Swamp.”

With this decade long battle behind True the Vote, the organization will now turn its effort to the 2020 election cycle, partnering with Our Values, a veterans’ rights organization founded by Benghazi hero Mark “Oz” Geist. The collaboration will focus on active and veteran military voter registration, recruiting and training for volunteer service as poll workers, and other GOTV activities targeted to mobilizing military and veteran families in the 2020 election.

    The seeding of the court system against the average citizen and defense of Socialist actions started with Clinton. Obama put it on steroids.

    This case will intensify the Leftest. It is unfortunate that our side looks at victories like this and say’s … good now we can relax. No this is a decades long battle. This is a toe hold.

    Taxpayer funded Officials Legal Fees to be paid by Taxpayers, No individual consequences for the criminal political misuse of governmental authority,

    Yes it is nice that some judge said the case was not wholly without merit.. But nothing has actually been legally done to prevent the same thing from happening again..Zero financial /legal consequences for those engaged in the activities..

    They won.

    This is not a victory, not even a minor setback to the deep state it’s minions or masters.

    I see that Lerner is mentioned but would like some clarification as to her personal responsibility/culpability. IE; will there be criminal action against her and others? Will she be held financially responsible for damages? etc.
    These zealots need to face full measures of pain for the very real damage they have inflicted on this country and its citizens.

    The “IRS” is we Americans and to fine the IRS is to fine the innocents. The “IRS” didn’t do anything. Lois Lerner in her capacity at the IRS with her boss Konkubine. They are the people that should pay, not we tax payers.

    And what if any will be their punishment ? Let me guess , the taxpayer will have to pay millions of dollars out and those government agencies will simply get a ” reprimand ” or slap on the wrist for getting caught. No real jail time and no Personal Financial Burden for their actions. That will show em. I bet others doing and planning more of the same are shaking in their boots.   8. This is really not what I want to hear. Who pays for the legal fee? You an me the taxpayer. Things like this will only impress me when those in charge of the IRS at that time are found out and prosecuted under the full extent of the law.

    There should have been, in this ruling or another court that these violations were criminal in nature to skew the election, because of institutionalized and imposed prejudice, just like Obama did by spying on Trump and his campaign. This is way past outrageous and has never been done before to an opposing candidate and campaign. Lois Lerner and all of the others involved need to do some time but never will. This is a travesty not justice for the horribly corrupt bureaucrats. We are not talking about stealing base runner signs here or deflating the football but we came close to allowing the second most corrupt person in our country to become President. WTF.

  13. Not sure how this could ever be considered an actual “win” against Lois Lerner and the IRS when all the “win” covers is attorneys’ fees recovery for the plaintiff. Lerner in particular has never received any sort of punishment for her abuse of position and betrayal of the very citizens she allegedly served.

She pay no penalty, no jailtime, no probation, nothing….. She is laughing all the way to the bank. Anyone who thinks this is harsh better think again…..     “…the only conservative voters rights organization in America…?” Has anybody heard of the Election Integrity Project, co-founded by President Linda Paine and Ruth Weiss? (Malcolm McGough is also involved.) Along with Judicial Watch, they have managed to get over 1.5 million inactive registered voters removed from the voter rolls. While EIP is not a national organization at present, they — and Judicial Watch — certainly merit appreciation for their tireless work and all the publicity they can get in this state. Our investigation of the IRS Targeting Scandal found that Lois Gail Lerner did not have any of the credentials required of Lerner when she was initially hired by DOJ’s Criminal Division, after graduating from law school. And, to demonstrate the cognitive dissonance that such a finding elicits from otherwise well meaning Americans, The Credential Investigation also found that Reggie B. Walton turned up withOUT APPOINTMENT AFFIDAVITS and withOUT the second OATH required of all Federal Judges. So, the ruling in question is not even worth its weight in toilet paper. On the merits, attorneys have almost unanimously run to defend the organizations targeted by that scandal, but the individuals who suffered severe retaliation, like this writer, cannot get to first base with any attorneys who place their wallets far above justice in this matter. To illustrate my point, try to find a single licensed attorney who has even read the Administrative Dispute Resolution Act of 1996 (“as an alternative to litigation in the Federal courts”). QED.

    Conservatives never win. The text to this story says Finally, the IRS and Lois Lerner were found guilty of numerous charges. But what charge was Lois Lerner found guilty of and what is her punishment? Will she now have a criminal record? I think the article is playing us for fools.
